2. Acceptance of Terms
By accessing our website or purchasing our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use our services.
3. Services
We offer customized digital solutions, including:
- Website design and development
- Branding and identity design
- UI/UX design
- Creative and digital strategy
All services are delivered based on project scope agreed upon with the client.
4. Payment Terms
- A 50% advance payment is required before the commencement of any project.
- The remaining 50% must be paid before final delivery or deployment.
- Payments once made are non-refundable, unless explicitly stated otherwise.
- Delayed payments may result in project suspension or additional charges.
- No final files, credentials, or assets will be delivered until full payment is received.
5. Refund & Cancellation Policy
- Once a project has started, no refunds will be issued.
- If a project is canceled by the client after initiation, the advance payment is non-refundable.
- Any additional work completed beyond the initial payment may be billed separately.
6. Project Timeline
- Project timelines are estimates and may vary based on scope and client responsiveness.
- Delays in providing content, feedback, or approvals may result in timeline extensions.
- NXT Studio is not responsible for delays caused by the client.
7. Client Responsibilities
The client agrees to:
- Provide all required content, materials, and approvals on time
- Ensure that all submitted content does not violate any laws or third-party rights
- Communicate feedback clearly and promptly
8. Revisions Policy
- Projects include a limited number of revision rounds (as agreed in the proposal).
- Additional revisions beyond the agreed scope will be charged separately.
9. Intellectual Property Rights
- All designs, code, and deliverables remain the property of NXT Studio until full payment is received.
- Upon full payment, ownership of the final deliverables is transferred to the client.
- NXT Studio retains the right to showcase completed work in its portfolio and marketing materials.
10. Third-Party Services
- Projects may involve third-party tools, plugins, hosting services, or APIs.
- NXT Studio is not responsible for issues, downtime, or changes caused by third-party providers.
11. Limitation of Liability
- NXT Studio shall not be liable for any indirect, incidental, or consequential damages.
- We do not guarantee specific business outcomes, revenue, or performance results.
- After project delivery, ongoing maintenance is not included unless agreed separately.
12. Confidentiality
Both parties agree to maintain confidentiality of any sensitive information shared during the project and not disclose it to third parties without consent.
13. Termination
- NXT Studio reserves the right to terminate a project if the client violates these Terms.
- The client may terminate the project, but payments made are non-refundable.
- Any completed work up to termination may be billed.
14. Privacy
Your use of our services is also governed by our Privacy Policy. We are committed to protecting your data and personal information.
15. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes shall be subject to the jurisdiction of courts in Karnataka.
16. Changes to Terms
We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our services constitutes acceptance of the revised Terms.
